AI Terms
In2ition AI, Inc.
Version: 2026-10-26
These AI Terms form part of the agreement between In2ition AI, Inc. (“Provider”) and its customer (“Customer”) for the in2ition.ai platform (the “Services”). They apply to the features of the Services that use artificial intelligence, including call analysis and scoring, coaching notes, summaries, and AI voice agents (the “AI Features”). Capitalized terms not defined here have the meanings in that agreement.
1. How the AI Features Work
1.1 The AI Features use machine learning models, which may be provided by third-party AI model providers, to process Customer Data and generate Outputs.
1.2 Provider chooses the models and model providers used in the Services and may change them at any time. During a paid term, Provider will not materially reduce the overall functionality of the Services ordered.
1.3 Outputs are generated by probabilistic systems. They may be inaccurate, incomplete, biased, or inappropriate, and the same input may produce different Outputs. AI voice agents may say things that are not in their instructions.
2. Customer Responsibilities
2.1 Review. Customer is responsible for reviewing Outputs before relying on them, and for deciding whether an Output is suitable for its purpose.
2.2 Human decisions. Outputs, including scores, rankings, and recommendations, are guidance only. They are not employment decisions, legal advice, or other professional advice. A human at Customer makes every decision that Customer takes using Outputs, including any decision about hiring, performance, discipline, or termination.
2.3 Instructions and content. Customer is responsible for the scripts, prompts, knowledge content, campaign settings, and other instructions it provides to the AI Features, and for the statements AI voice agents make based on them.
2.4 Disclosure. Customer is responsible for telling Call Recipients that they are interacting with an AI voice agent, and that a call is recorded or analyzed, wherever the law requires it.
2.5 Laws on automated tools. Customer is responsible for complying with laws that regulate the use of artificial intelligence or automated tools, including in employment and hiring, such as requirements for notice, consent, impact assessment, or bias audit.
2.6 Acceptable use. Customer will use the AI Features in compliance with the Acceptable Use Policy.
3. Data Use
3.1 Provider may use Customer Data to provide, maintain, support, secure, test, evaluate, and improve the Services.
3.2 Provider does not use Customer Data to train AI models without Customer’s written agreement.
3.3 Where a third-party AI model provider used in the Services offers controls that prevent it from using customer data to train its own models, Provider configures those controls so that the provider does not use Customer Data to train its models.
3.4 Provider may create and use Aggregated Data, which Provider owns, as described in the agreement.
3.5 Provider does not sell Customer Data.
4. Ownership of Outputs
As between the parties, Outputs are Customer Data and belong to Customer. Because of the nature of AI, Outputs may be similar to outputs generated for others, and Customer has no rights in other customers’ outputs.
5. Disclaimer
PROVIDER MAKES NO WARRANTY THAT OUTPUTS WILL BE ACCURATE, COMPLETE, UNBIASED, OR SUITABLE FOR ANY PURPOSE, OR THAT THEY DO NOT INFRINGE THIRD-PARTY RIGHTS. CUSTOMER’S USE OF OUTPUTS IS AT ITS OWN RISK, SUBJECT TO THE AGREEMENT.
6. Updates
Provider may update these AI Terms as its agreement with Customer allows.
